We, ALT NEW ZEALAND LIMITED, of PO Box 14086, Panmure, Auckland 1072, New Zealand (“alt.”, “ALT NEW ZEALAND” “We”, “Us” or “Ours”) make available to alt. customers (“You”, “Your” or “Customer(s)”) the promotion described on the alt. website (www.getalt.co.nz)  and various partner and social media sites (“Promotion”), subject to the terms and conditions contained herein (“Terms”). 

By proceeding with the Promotion and engaging further with Us, You agree to be bound by and to abide by these Terms.

1. Promotion

1.1. The following specific discount, reward, goods or services (“Offer”) shall be provided as our Promotion to Customers subject to the Terms:

1x 100% off discount is limited to one of the following:

- 1x alt. starter kit (any flavour) conditional on the kit being the first kit of a customer following registration online. Customers can only register their age 1 time. 1 Kit per customer per registration.

- Promotion runs from 19.01.2022 until 28.02.2022 unless otherwise extended or restricted - customers will have this time period to use the offer code.

1. Terms and Conditions

To receive the Offer and to participate in the Promotion, Customer agrees as follows:

1. Customer is required to enter their email and choose a password on the alt. website. Customer will then be required to verify their age with a valid, government issues, New Zealand identity document. Customer must be a new customer to participate in the Promotion.
2. The Promotion may require the customer to undertake further actions not described in these Terms, for example choosing the flavour and nicotine strength of the discounted item.
3. The Promotion is subject to available inventory and stock, including a limited allocation for the Promotion. Certain stock or inventory may not be made available for the Promotion.
4. As a condition of the Promotion, Customer must provide their contact information and agrees to opt-in to receive marketing emails, subject to the terms of Our Privacy Policy.
5. Except as expressly stated herein, including at Section 1 (Promotion), this Promotion may not be used in conjunction with any other Offer or promotion currently made available by alt.
6. This Promotion may only be redeemed once per Customer. Customers who attempt to utilise this Promotion more than once may have their orders cancelled.
7. The Promotion is available online only at www.getalt.co.nz and is not available at our physical stores or the stores of our distributors.
8. Customer confirms they are a resident of New Zealand and currently in New Zealand at the time of any engagement in the Promotion
9. Customer confirms to Us that they are 18 years or over and a current smoker or vaper. Customer confirms that they have a valid identity document issued by a competent authority providing age verification, and that they will provide this to Us in accordance with our age verification policies and procedures and subject to the terms of Our Privacy Policy (“Age Verification”). Customer understands that if they fail to complete the Age Verification they will not be able to participate in the Promotion nor receive the Offer.  Any Promotion of Offer is void where prohibited by applicable law or where the Customer is under 18.
10. We reserve the right to scrutinise all Customer details and decline the Offer to any prospective customer or person in our sole discretion and without limitation.
11. Promotion not available to trade accounts or wholesale customers. 

3. Miscellaneous

All personal data shared by You with Us in relation to this Promotion are held by Us subject to the terms of Our Privacy Policy made available at www.getalt.co.nz/pages/privacy-policy. By participating in the Promotion you agree to the terms of Our Privacy Policy.

No refunds, returns or exchanges will be entertained except as required by applicable law.

With the exception of liability which cannot be limited or excluded by applicable law, We (including Our Affiliates, related companies and their and Our respective officers, agents and employees) exclude and limit all applicable liability, including for death, personal injury, loss or damage (including loss of opportunity and whether direct, indirect, special or consequential) suffered or incurred by any person (whether or not arising from any person's negligence) arising in any way out of or in connection with the Promotion or the Offer.  Without limiting the aforesaid this shall include: a) theft, mail delivery failure, unauthorised access or third party interference; b) any technical difficulties or equipment malfunction (whether or not under Our control); c) any tax liability incurred by You including self-assessed tax liabilities; d) Your participation in or use of the Offer.

Customer indemnifies and will keep indemnified alt. against all loss and damage whatsoever suffered (including but not limited to indirect or consequential loss) by alt. arising out of any failure of the Customer to adhere to these Terms.

ALT NEW ZEALAND electronic cigarettes may be hazardous to health and contain nicotine which is addictive. ALT NEW ZEALAND electronic cigarettes are not suitable for use by: persons under the age of 18; persons who are allergic/sensitive to nicotine; pregnant or breast-feeding women; persons who should avoid using tobacco or nicotine products for medical reasons; or persons with an unstable heart condition, severe hypertension or diabetes. Keep ALT NEW ZEALAND products out of reach of children.

These Terms, and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by, and construed in accordance with the laws of New Zealand.

Each party irrevocably agrees that the courts of Auckland, New Zealand, shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation.

We reserve the right to change, amend, withdraw or cancel this Promotion or these Terms at any time without notice in our absolute and sole discretion.
